Terms and Conditions

These Terms govern access to and use of AutoSetter, a service provided by Replacing Humans, S.L. ("AutoSetter", "we", "us" or "our"), Spanish tax ID B27595743, with registered office at Calle Paca Diaz 12, Bajo B, 28023 Madrid, Spain, and contact email nico@autosetter.live.
Replacing Humans, S.L. is registered with the Madrid Commercial Registry, Section 8, sheet M-887436, entry 1.
1. Scope
AutoSetter is an AI-powered software service for Instagram-first sales operations. It may connect professional Instagram accounts through Meta's official APIs and assist with or automate direct messages, comments, lead qualification, follow-ups, CRM activity, bookings, reporting and related workflows.
These Terms apply to the website, software, dashboard, integrations, support and related services. Prices, duration, payment, cancellation, refunds, service levels and other commercial conditions are governed by the applicable order, proposal or signed contract. That document prevails for the matters it specifically regulates. Mandatory rights always prevail.
2. Access and authority
You must be at least 18 years old and legally able to enter into a contract. If you use AutoSetter for an organization, you confirm that you are authorized to act for it.
Access to an enabled account is subject to these Terms and the applicable commercial agreement. Where applicable law requires a specific form of acceptance or additional pre-contract information, those requirements apply independently.
3. AI automation and human control
When automation is enabled, AutoSetter can generate and send messages without prior human approval. Customers can pause automation, intervene in conversations and use the human-control features available in the product.
AI outputs may be inaccurate, incomplete or unsuitable. You remain responsible for your offers, prices, claims, instructions, connected accounts and use of generated messages. AutoSetter does not provide legal, medical, financial or other professional advice.
4. AI transparency
Where applicable law requires people to be informed that they are interacting with an AI system, including the transparency rules applicable from 2 August 2026, customers must use the disclosure functionality or wording made available for that purpose and must not remove or conceal a legally required disclosure.
Each party remains responsible for the legal obligations that apply to its role. Product settings or contractual instructions cannot waive a mandatory transparency obligation.
5. Acceptable use
You must have authority and an appropriate lawful basis to connect accounts, provide instructions and process messages or lead data. You must comply with applicable law and with Meta and Instagram rules.
You must not use AutoSetter for spam, unlawful scraping, impersonation, fraud, deception, harassment, rights infringement, illegal goods or services, circumvention of provider restrictions, or content prohibited by Meta or applicable law.
Uses involving regulated activities, special-category data, minors, vulnerable people or decisions with legal or similarly significant effects remain the customer's responsibility and require the lawful bases, notices, safeguards and human oversight applicable to that use.
6. Meta and other services
AutoSetter depends on Meta, Instagram and other technology providers. We are not affiliated with or endorsed by Meta. Provider outages, API changes, rate limits, account restrictions, policy changes or enforcement decisions may affect the Service and may be outside our control.
7. Customer content and data
You retain ownership of content and business materials you provide. You authorize us to host, process, transform and transmit them only as needed to provide, secure and support the Service, subject to the applicable agreement and our Privacy Policy.
You are responsible for ensuring that your instructions, notices and lawful bases cover your use of AutoSetter with leads and other end users.
8. Intellectual property
AutoSetter's software, interfaces, workflows, documentation, prompts, agents, models, trademarks and other materials belong to Replacing Humans, S.L. or its licensors. Your right to use the Service is limited, non-exclusive and subject to the applicable agreement.
You may not copy, resell, sublicense, reverse engineer or use the Service to build a competing product except where such restriction is prohibited by law.
9. Suspension and termination
We may suspend access where reasonably necessary because of a security risk, fraud, unlawful activity, serious provider-policy violation, material breach or conduct that risks the shared Meta integration or other customers. Payment defaults and contractual termination are governed by the applicable order or signed contract.
10. Service limitations
We provide AutoSetter with reasonable professional care. AI and third-party services can fail or change, and we do not guarantee particular sales, revenue, response, booking or conversion results.
Any warranties, liability limits, indemnities or remedies are governed by the applicable signed agreement and mandatory law. Nothing in these Terms excludes liability or rights that cannot legally be excluded.
11. Privacy
Our processing practices are described in the Privacy Policy. When we process customer lead or end-user data only on a customer's documented instructions, the customer is normally the controller and Replacing Humans, S.L. is the processor. The applicable signed data-processing terms govern that processing.
12. Changes and governing law
We may update these Terms for legal, security, provider or product reasons and will give notice of material changes where required. A change to these public Terms does not by itself alter a signed commercial agreement.
These Terms are governed by Spanish law, without limiting mandatory rights or forums. Dispute provisions in an applicable signed agreement prevail for the matters they regulate.
